1. Acceptance of Terms

By accessing or using the HolaRoof platform, website, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms constitute a legally binding agreement between you and HolaRoof S.L. (registration number B22655179), Avenida Teodomiro 19, 03300 Orihuela, Alicante, Spain.

2. Description of Service

HolaRoof provides a platform for solar roofing solutions, including a 3D roof configurator, project management tools, bill of materials (BOM) generation, and a partner network for certified installers. The Service is available to registered users including homeowners, installers, and business partners.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Infringe upon the intellectual property rights of others.
• Upload malicious code, viruses, or harmful content.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Use automated tools to scrape, crawl, or extract data from the platform without permission.
• Interfere with or disrupt the integrity or performance of the Service.

5. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, software, and the 3D configurator technology, are the exclusive property of HolaRoof S.L. or its licensors and are protected by international copyright, trademark, patent, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

6. User Content

You retain ownership of content you submit through the Service, including project data, images, and notes. By submitting content, you grant HolaRoof a non-exclusive, worldwide license to use, store, and process such content solely for the purpose of providing and improving the Service. You are responsible for ensuring that your content does not violate any third-party rights.

7. Partner Program

Participation in the HolaRoof partner program is subject to additional terms and approval by HolaRoof. Partners must maintain applicable certifications and comply with quality standards as specified in the partner agreement. HolaRoof reserves the right to modify partner program terms or revoke partner status at its discretion.

8. Limitation of Liability

To the maximum extent permitted by applicable law, HolaRoof S.L. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you have paid to HolaRoof in the twelve (12) months preceding the claim.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. HolaRoof does not warrant that the Service will be uninterrupted, error-free, or secure. Any reliance on the platform's configurator results, BOM calculations, or pricing estimates is at your own risk.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time through your profile settings. Provisions that by their nature should survive termination shall remain in effect.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain and applicable European Union regulations. Any disputes arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts of Alicante, Spain. Nothing in these terms affects your statutory rights as a consumer under EU law.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of the Service after changes are posted constitutes acceptance of the modified terms. For material changes, we will notify registered users via email.
